General Terms and Conditions of Sale (GTC)

1) Scope and Parties
These GTC govern sales concluded via www.swissfungi.org, operated by MYCELIUM (sole proprietorship), Rue de Zähringen 7, 1700 Fribourg, Switzerland.

Any order placed by a private or professional customer implies full and unconditional acceptance of the GTC in force at the time of the order.
2) Products, Information and Availability
Descriptions, photos and technical data sheets are provided for information purposes only; slight variations may occur.
Our offers are valid as long as they are visible on the website and subject to available stock. A confirmation of availability is sent by email after the order has been placed.
Important: Our products are intended solely for the inoculation of sterile media for cultivating mycelium or mushrooms and are not intended for consumption. Only properly identified mushrooms should be consumed. Do not consume raw mushrooms.
3) Prices, Taxes and Fees
Prices are indicated in CHF and include all non-optional taxes and charges. Delivery costs are indicated separately before order confirmation.
For deliveries outside Switzerland, duties and taxes may apply and are the responsibility of the customer.
4) Ordering Process and Conclusion of the Contract
The ordering steps are displayed up to the “Order / Buy (payment obligation)” button. You can review and correct your data before confirming the order.
The contract is concluded when we accept your order by email confirmation of shipment or, failing that, upon delivery of the products.
We reserve the right to refuse an order for legitimate reasons, such as unavailability, invalid address or suspected fraud.
5) Payment Methods
We accept Visa and Mastercard payments via Stripe. Payment is charged at the time of the order.
6) Delivery, Delivery Times and Transfer of Risk
Delivery is carried out by Swiss Post to the address provided. Delivery times displayed are indicative only; we will inform you in the event of a significant delay.
The risk passes to the customer upon delivery. If you appoint a carrier not proposed by us, the risk passes upon handover to that carrier.
7) Retention of Title
The products remain our property until full payment has been received. We reserve the right to register the retention of title in the competent register.
8) Right of Return
You have 14 days from receipt to return, at your own expense, any unused, unopened, complete and new item in its original sealed packaging.
After inspection, we will refund the product price, excluding the initial shipping costs.
Exceptions: Opened, used, damaged or incomplete items cannot be returned.
For sterile or perishable products, such as syringes, liquid cultures, grain spawn or inoculated kits, only returns that remain sealed and are clearly unused will be accepted.
9) Receipt and Non-Conformities (DOA)
You must inspect the goods upon receipt. Any deterioration or non-conformity, such as missing or damaged products, must be reported in writing within 48 hours, together with photos or supporting evidence.
Sterile products: In the event of contamination on arrival (DOA), we will, after verification, provide a replacement or credit note.
No warranty is due if the storage or handling conditions, such as 2–8 °C and aseptic handling, have not been respected.
10) Legal Warranty and Limitations
We apply the Swiss legal warranty for material defects under the Swiss Code of Obligations (CO). At our discretion, we will repair, replace or refund the defective product.
Specific conditions for living or sterile products: Viability depends on transport conditions, storage conditions (2–8 °C), aseptic handling and the customer’s substrate. Our warranty covers the condition of the product at shipment — sealed, sterile and ready for use — but not the success of cultivation.
To the extent permitted by law, our liability is excluded for indirect or consequential damages, such as loss of profit or loss of data. No exclusion applies in cases of intent, gross negligence, or injury to life, body or health.
11) Proper Use and Compliance
You undertake to use the products in accordance with their instructions and applicable legislation. Our inoculation products are not intended for consumption and may be reserved for adults.
12) Data Protection
The processing of personal data is described in our Privacy Policy available on the website. By placing an order, you accept this processing.
13) Intellectual Property
The contents of the website, including texts, visuals, trademarks and logos, are protected. Any unauthorized reproduction is prohibited.
14) Force Majeure
We are not liable for delays or non-performance due to a force majeure event, such as widespread outage, administrative decisions, disasters, strikes or pandemics. Performance is suspended for the duration of the event.

16) Applicable Law and Place of Jurisdiction
Swiss law applies, excluding conflict-of-law rules. Mandatory consumer protection jurisdictions remain reserved; you may bring proceedings at your place of residence.
Failing this, the place of jurisdiction is Fribourg.
17) Amendments to the GTC
We may adapt these GTC at any time. The applicable version is the one available online at the time of the order. Amendments do not apply to contracts already concluded.
18) Severability and Language
If any clause is invalid, the remaining clauses shall remain applicable. A valid clause shall replace the invalid clause, reflecting as closely as possible the economic intention.
In the event of discrepancies between different language versions, the French version shall prevail.sion française prévaut.
